Claims that made the news in September and October 2021

blog

Hello!
Can you believe we arrived in the last week of October? It's 62 days until Christmas and less than 70 days until 2022 is here!
That means you'll still have a few more wonderful and informative posts from #MondayBlog to enjoy in the year 2021.

But leaving the dates aside, let's get down to business. As usual, for the last three months, we have been using our blog to share with you, dear reader, claims that have reached the world media, in order to show that accidents do happen, both on film sets and at events.< br>
And we'd like to use this opportunity to explain what kind of insurance and coverage would be triggered if this situation had happened to your project.
So, let's go to the news?

RUST – ALEC BALDWIN
Civil Liability and Personal Accidents

Let's start with the topic of the moment.
Alec Baldwin accidentally shot and killed 42-year-old cinematographer Halyna Hutchins on the film set of the film Rust on October 21st.
In addition to the terrible tragedy of the director's death, 48-year-old director Joel Souza was also injured.

Rust is a western movie and the accident happened when Baldwin was rehearsing a scene that required someone to fire a scenographic gun and the shrapnel from those shots hit both directors. The type of ammunition used in the weapon used in the shooting is not yet known, and the accident is under investigation.

PA and CL
From an insurance point of view, the Personal Accident coverage must have been activated twice. One with accidental death for director Halyna's family and medical expense coverage for director Joel.

The director's family can trigger the production and claim compensation within the civil liability coverage, and it is very likely that they will. Since it is the production's obligation to guarantee the safety and physical integrity of everyone.

Accidents happen on film sets, we stress once again.
We at Prospecto are saddened to see the loss of a life in something so inexplicable. Our sincere feelings to the director's family.

SECURITY GUARD DIES AFTER BEING ASSAULTED IN EVENT
Civil Liability

Edson was working as a security guard at an event at the Parque de Exposições in Divinópolis on September 25, when he was attacked by businessman Pedro Lacerda, who was attending the party.

Security stopped the businessman from entering an area he was not allowed to enter, and the enraged businessman punched Edson with the aid of an English punch. The victim fell unconscious after the blow, and even after assistance provided by SAMU, he did not resist.

Another CL case
The organizer of this event failed on security and how ironic is that, isn't it. It is the duty of every event organizer to check all entries in order to prevent people from entering armed with any types of weapons at their event.
If the organization had done its job well, the entrepreneur might even have punched the bouncer, but maybe Edson was alive today.
Therefore, we believe that if the security guard's family sues those responsible for this event, they will earn a compensation that is very difficult to calculate. After all, how much is a life worth?

Not to mention the question of the aggressor himself, who must be properly tried and punished for his crime.

ROUND 6 (Squid Game)
E&O Problems

That Round 6 has turned into a fever this past month, everyone knows. But did you know that this production had a claim? It really didi!
In a scene that shows the financial problems of protagonist Gi Hoon (Jung-jae Lee), the character accepts to participate in a mysterious game. The proposal to join the game is made through a phone call, and that's where the problem happened. Because the production used a number that exists in real life, and belongs to a trader in Korea.

Classic case of E&O, where there was a very silly mistake, which cost money to the producer, because that merchant did not hesitate to sue them. Once viewers of the show started to call and send messages to that number, which caused a lot of inconvenience for the owner of the phone.

Netflix offered a deal with the woman, offering damages of 24,000 BRL (one million won) and advising the victim to change her number. And Netflix declared that they could do nothing else since it was a sincere mistake, and that the number was already known to everyone.

THAÍS CARLA X LÉO LINS
Moral Damage

The dancer and influencer was victorious in the legal battle she was waging against comedian Léo Lins, from SBT's “The Night” program. The lawsuit for moral damages was due to the fat-phobic comments made by the comedian. Léo Lins will have to indemnify the dancer in R$ 5 thousand and without the right to appeal.

During the sentence, the judges declared that the comedian was offensive, promoting hate speech and inciting people to attack the dancer on social media.

Moral Damage Liability
Simple, clear and evident. Was there damage? Yes, Thais was verbally attacked, suffered emotional and professional damage due to the comedian's comments, so civil liability is present in this story.

What a liability claim festival, wasn't it?
It even seems serendipity that we, at Prospecto, have decided to make the month of November, the Liability Month here at #MondayBlog.

We are very excited to have the opportunity to explain in detail each facet of the multifaceted actions of liability coverage.

We're waiting for you for the next #MondayBlog.
Have a great week, lovers!
